The contribution of the Constitutional Court to the emergence of a new constitutional order in Morocco

The Moroccan Constitution of 2011 enshrines a wide range of fundamental rights and freedoms, while for the first time introducing the principle of separation and balance of powers. In order to ensure the effectiveness of these advanced provisions, it provides for the establishment of a Constitutional Court, whose composition and powers clearly affirm its judicial nature. Although this Court is expected to play a key role in the emergence of a new constitutional order in Morocco, it appears that its contribution remains limited, due to both internal and external factors.
