The role of the constitutional judge in the Moroccan constitutional revision procedure

The Moroccan constitutional revision procedure, as defined by the 2011 Constitution, embodies the tension between adaptability and fundamental stability. This article analyzes this process through two lenses: the formal and substantive framework limiting the derived constituent power, and the role of the constitutional judge in overseeing it. By examining pre-2011 jurisprudence, the article demonstrates that control has historically been restricted to procedural regularity, leaving open the question of a substantive review of “unamendable” core principles. It concludes with the need for jurisprudential evolution to empower the judge as the effective guardian of constitutional identity.
